Terms & Conditions
Welcome to The Childcare Hack. These Terms and Conditions ("Terms") govern your access to and use of the website and calculator (the "Service") provided by The Childcare Hack Ltd, 128 City Road, London, United Kingdom, EC1V 2NX, registered in England and Wales, company number 17416566 ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to comply with and be bound by these Terms.
1. Acceptance of These Terms
1.1 By accessing or using the Service, you confirm that you accept these Terms and agree to be bound by them. If you do not agree to these Terms, you must not use the Service.
1.2 These Terms should be read alongside our Privacy Policy.
2. User Information and Privacy
2.1 Information We Collect
When you use our Service, we collect the following information:
- Your income (and your partner's income, if applicable)
- Your employment status and existing pension contributions
- The number and ages of your children
- Your monthly childcare costs
- If you book a call with one of the FCA-regulated advisers on our panel: your name and email address
2.2 Use of Information
We use the information provided by you to create a personalised report showing your position relative to the £100,000 threshold and the government childcare support and pension tax relief available to you. If you book a call, we also use your name and email address to arrange it, and we allow the FCA-regulated adviser handling your call to review the information you supplied when generating your report, so the call can be relevant to your circumstances.
2.3 Data Storage
Your calculator inputs and report are stored locally in your own browser. If you book a call, your name, email address, and the report information shared with your adviser are stored securely in our CRM system, which is access-controlled through two-factor authentication and a strict user access policy.
2.4 Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and protect your information.
3. Payment and Refund Policy
3.1 Payment
Users are required to pay a one-time fee for access to the Service.
3.2 Refunds
If you are not satisfied with your purchase, you may request a refund within 30 days of receiving the product. To request a refund, please contact us at hello@thechildcarehack.co.uk.
3.3 Your Statutory Cancellation Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel a contract for digital content bought at a distance. Because your report is generated and made available to you immediately, by completing your purchase you expressly request that we begin supplying the digital content straight away, and you acknowledge that you will lose your statutory right to cancel once it has been supplied.
This does not affect the 30-day refund described in clause 3.2, which we offer in addition to your statutory rights, and it does not affect any other right you have under the Consumer Rights Act 2015 where digital content is faulty, not as described, or not supplied with reasonable care and skill.
4. Disclaimers and Limitation of Liability
4.1 No Financial Advice
The Company is not authorised or regulated by the Financial Conduct Authority and does not provide financial, tax, investment or pension advice of any kind. Nothing on our website, in our calculator, or in the report generated by the Service is a personal recommendation. The report is produced solely from the information you provide, is generic information and guidance only, and does not take account of your wider circumstances, objectives, knowledge and experience, or attitude to risk.
Any personalised financial advice is provided only by an adviser authorised and regulated by the Financial Conduct Authority, and only on a call you separately choose to book. That adviser acts independently of the Company. Advice given on that call is the responsibility of the adviser and their firm, is governed by their own terms of business and complaints procedure, and any complaint about that advice should be directed to them. You can check an adviser's authorisation on the Financial Services Register at register.fca.org.uk.
We do not receive any fee, commission or other benefit from the adviser or their firm for introducing you to them. The only payment we receive is the one-off fee you pay us for your report.
4.2 Accuracy of Information
While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or usefulness of any information provided, and figures are estimates that cannot be relied on to determine eligibility for any government scheme.
4.3 No Guarantee of Eligibility
The Service does not determine your eligibility for Tax-Free Childcare, the funded childcare hours entitlement, Child Benefit, or any other government scheme. Eligibility is determined solely by HMRC and, where relevant, your local authority. Figures produced by the Service are estimates based on the information you enter and on the rules as we understand them at the date stated in the report, and must be confirmed with HMRC, a qualified accountant, or a regulated adviser before you act on them or make any application.
4.4 Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. Nothing in these Terms affects your statutory rights as a consumer.
Subject to the paragraph above, our total liability to you arising out of or in connection with these Terms or your use of the Service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited in aggregate to the amount you paid us for the report.
We are not liable for any advice given to you by an FCA-regulated adviser, for any act or omission of that adviser or their firm, or for any decision you take on the basis of the report, including any application you make or any change you make to your income, contributions or financial arrangements.
5. Age Restrictions
5.1 Users must be over 18 years old to use the Service.
6. Customer Support
6.1 For customer support, you can contact us at hello@thechildcarehack.co.uk. While we cannot provide individual financial advice, we can assist with questions about the Service. We aim to respond within 48 hours.
7. Termination
7.1 We reserve the right to terminate your access to the Service for any reason, including but not limited to violation of these Terms, misuse of the Service, or engaging in fraudulent or illegal activities.
8. Changes to Terms
8.1 We may update these Terms from time to time. Any changes will be posted on our website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
9. Governing Law
9.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
10. Contact Information
10.1 If you have any questions about these Terms, please contact us at hello@thechildcarehack.co.uk.
